The rules for using My Food Rating.

These Terms of Use ("Terms") govern your access to and use of the My Food Rating mobile app and the myfoodrating.com website (together, the "Service"), operated by Trillion.com Pty Ltd ("Trillion", "we", "us", "our").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

My Food Rating is a personal food journal that lets you rate restaurants and menu items, record visits as journal entries, and attach photos to your entries. The Service is provided to you free of charge.

Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of digital consent in your jurisdiction (which is up to 16 in some EEA member states), you may only use the Service with the involvement of a parent or guardian.

Your account

To use the Service, you create an account using one of the following methods:

Sign up with an email address and a password you choose
Apple Sign-In
Google Sign-In

Some features may require you to verify your email address before they become available.

You are responsible for:

Keeping your password, sign-in credentials, and device secure
All activity that occurs under your account
Providing accurate information

You can delete your account at any time from within the My Food Rating mobile app. Our Account Deletion page explains the process and what data is removed.

Your content

The Service lets you submit content, including ratings, written reviews, journal entries, and photos ("Your Content").

You retain ownership of Your Content. By submitting Your Content to the Service, you grant Trillion a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and modify Your Content for technical purposes (such as resizing photos) for the sole purpose of operating and providing the Service to you. This licence ends when you delete Your Content or your account, except to the extent we are required by law to retain copies.

You are solely responsible for Your Content. You represent and warrant that:

You own Your Content or have all rights necessary to submit it
Your Content does not infringe any third party's intellectual property, privacy, or other rights
Your Content complies with these Terms and applicable law

We may remove or restrict access to any content that, in our reasonable judgement, breaches these Terms.

Acceptable use

You agree not to:

Use the Service for any unlawful purpose
Submit content that is defamatory, harassing, hateful, or that threatens or violates the rights of others
Submit content that infringes any intellectual property or privacy rights
Attempt to interfere with, disrupt, or compromise the security or integrity of the Service
Access the Service through automated means (bots, scrapers, crawlers) except as expressly permitted by us in writing
Use the Service to send spam or unsolicited communications
Impersonate any person or misrepresent your affiliation with any person or entity

Intellectual property

The Service, including all software, design, text, graphics, and trademarks (other than Your Content), is owned by Trillion or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.

Third-party services

The Service integrates with third-party services, including Apple Sign-In and Google Sign-In. Those services are governed by their own terms and privacy policies, and we are not responsible for them. Restaurant and place information shown in the Service may be sourced from third-party data providers; we do not warrant the accuracy or completeness of that information.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, Trillion disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any information on the Service is accurate or complete. Restaurant information, menu items, ratings, and other content visible on the Service may be user-generated and is not verified or endorsed by Trillion.

Nothing in these Terms is intended to exclude any non-excludable consumer guarantee or right that applies to you under the Australian Consumer Law or any other applicable consumer protection law.

Limitation of liability

To the maximum extent permitted by law, Trillion will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Service.

Where liability cannot be excluded, Trillion's total liability is limited to the greater of (a) the amount you have paid for the Service in the 12 months preceding the claim (which, because the Service is free, may be zero), or (b) AUD $100.

Termination

We may suspend or terminate your access to the Service, in whole or in part, at any time if you breach these Terms or if we are required to do so by law. You may stop using the Service at any time by deleting your account.

Provisions that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and governing law — will survive.

Changes to these Terms

We may update these Terms from time to time. The current version is always available at this page, and the "Last updated" date will reflect the latest revision. Material changes will be communicated through the Service or by email. Your continued use of the Service after a change constitutes acceptance of the updated Terms.

Governing law and jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia, without regard to its conflict-of-laws rules. The courts of Victoria, Australia, have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, subject to any non-waivable rights you have under applicable local law.
